Woman blames Elmhurst hospital, doctor for husband's death

A Cook County woman is suing Elmhurst Memorial Hospital and a doctor, alleging wrongful death in her husband's passing.

Andrea Gebhart, as special administrator of the estate of Leon Gebhart, filed a lawsuit July 27 in Cook County Circuit Court against Dr. Phillip Cozzi, the hospital and Elmhurst Clinic, alleging negligence.

According to the complaint, Dr. Cozzi practiced careless judgment while examining Leon Gebhart for a CT scan chest X-ray that revealed several pulmonary nodules, which allegedly contributed to Gebhart's death from malignant lymphoma July 31, 2013. The suit says the death followed Cozzi’s refusal to not order a biopsy on the nodules, but rather request three more CT scans from July 2012 to July 2013.

Andrea Gebhart seeks in excess of the jurisdictional minimum required by the court, plus legal costs. She is represented by attorney Brion W. Doherty, of Motherway & Napleton in Chicago.
