Patient sues doctor, alleging botched appendectomy

A patient is suing his Cook County doctor and medical group, claiming medical malpractice in a 2014 procedure which allegedly resulted in infection requiring secondary surgery.

Raymond Simpson brought a lawsuit against Little Company of Mary Hospital and Health Care Centers Inc. and Dr. Michael Hurtuk on July 28 in Cook County Circuit Court, alleging negligence in the November 2014 operation.

The suit states when that Simpson underwent an emergency laparoscopic appendectomy on Nov. 24, 2014, the doctor inadvertently failed to remove the entire organ and left “a stump appendix” of approximately 3 centimeters. The plaintiff alleges the site later became re-infected and ruptured on or about March 30, 2015, forcing him to be subjected to a second and more invasive surgery.

According to the complaint, as a proximate result of the doctor’s alleged professional negligence, Simpson sustained pain and suffering, disfigurement, loss of a normal life, and medical expenses that would have been avoidable with sufficient care during the first operation.

The plaintiff charges the defendant with medical malpractice and demands judgment of more than $50,000, plus attorneys’ fees and costs. He is represented by Donald Shapiro and Matthew Basinger of Donald A. Shapiro in Chicago.
