Family alleges man's cancer diagnosis came too late

The daughter of a man who died of prostate cancer is suing his former care provider for allegedly overlooking positive cancer screenings for nearly two years.

Margaret Webster, administrator of the estate of Albert Webster, filed a lawsuit Aug. 6 in Cook County Circuit Court against Caring Tree and Caring Tree Inc., doing business as Caring Tree Home Healthcare Services, and Dr. Ronald Sam, alleging negligence and wrongful death.

According to the complaint, from 2011 to 2013, Albert Webster received annual wellness exams from Caring Tree, and his lab results to screen for prostate cancer contained a high level of PSA all throughout 2012 and 2013, which indicated a strong likelihood of prostate cancer. The lawsuit states, however, "at no time during or immediately after these check-ups did Caring Tree advise Albert to seek care and treatment from an oncologist for his high risk of prostate cancer."

Webster was not diagnosed with cancer until August 2013, the lawsuit states, and he he died three months later.

Margaret Webster seeks damages of more than $200,000, plus costs. She is represented by attorney Isaac Rabicoff of The Law Offices of Scott A. Kogen & Associates in Chicago.
