Amputee alleges failed prosthesis due to botched procedure

A patient is suing his doctor and affiliated facilities, alleging medical malpractice in a 2013 surgical procedure which he claims led to irreversible complications resulting in permanent disability.

Walter Swiercz brought a lawsuit against Cardiothoracic & Vascular Surgical Associates SC of Oak Lawn, Sanjeev Pradhan, Advocate Christ Medical Center, and Advocate Health and Hospitals Corp., doing business as Advocate Christ Medical Center, in Cook County Circuit Court on Aug. 3, alleging medical malpractice in the August 2013 procedure which he claims led to what could have been an avoidable “wheelchair existence.”

According to the complaint, Swiercz underwent a below-knee amputation of his right leg on Aug. 2, 2013, at Christ Medical Center in Oak Lawn; and subsequently a “revision” on Dec. 4, 2013.

The plaintiff states that his prosthetic device failed following the alleged procedures and must permanently rely on a wheelchair for mobility.

The lawsuit states that the defendants failed to offer and perform any “alternative of a limb salvage procedure,” or to perform the surgery in a manner that the condition of the bone at the amputation site allowed the prosthetic to work.

Swiercz charges the defendant with medical negligence and malpractice.

Demanding judgment more than $50,000 plus attorney’s fees and costs. He is represented by Gregory Olmstead of The Deratany Firm in Chicago.
