Lexington Health Care Center of Streamwood sued over allegations of negligence

Derrick Dyson, administrator of the estate of the deceased Annie Dyson, is suing a long-term health care facility over claims of negligence that resulted in Annie Dyson's scabies infection.

Derrick Dyson filed a complaint Aug. 31 in Cook County Circuit Court against Lexington Health Care Center of Streamwood Inc., alleging negligence in violation of the Nursing Home Care Act.

The complaint states that Dyson employed Lexington of Streamwood to provide nursing home services to Annie Dyson.

The complaint states that during Annie's residency at Lexington of Streamwood, including the time period from Sept. 18, 2013, to Oct. 8, 2013, staff at the center were negligent in their care of Annie, resulting in her severe agitation and a scabies infection.

Specifically, the complaint alleges, center staff allowed the scabies infection to develop due to their neglect, then failed to adequately supervise medical and personal care as needed to treat the scabies infection, allowed it to go undiagnosed and untreated, and failed to inspect her skin for evidence of infection.

Dyson seeks damages of more than $50,000, plus court costs and attorney fees. He is represented by Samantha Sindles of Dudley & Lake, LLC in Libertyville.
