Man sues over alleged negligence for death of his mother following vehicle collision near Westfield Fox Valley Mall

A man is suing a driver over claims of negligence following a vehicle collision that left his mother dead due to resulting injuries.

Douglas Bair, individually and as special administrator of the estate of deceased Dorothy Lineback, filed a complaint Aug. 21 in Cook County Circuit Court, Law Division against Alafia Nomani, alleging negligence.

On Aug. 24, 2014, the complaint states, Lineback was a passenger in a vehicle traveling northbound on Route 59 in Aurora, near the intersection with La Fox Avenue and Entrance No. 1 to the Westfield Fox Valley Mall.

At this time, Nomani, driving a 2011 GMC Acadia southbound on Route 59 near the same intersection, attempted to make a left-hand turn onto eastbound La Fox Avenue even though he was faced with a red light. As Nomani entered the intersection, he collided with the front end of the vehicle in which Lineback was a passenger, according to the complaint.

The complaint states Nomani was negligent in failing to keep a proper lookout, speeding, failing to yield the right of way, failing to obey the traffic signal, and other negligent acts or omissions.

As a result of the collision, Lineback sustained personal injuries resulting in her death.

Bair, Lineback's surviving son, seeks a judgment of more than $50,000, plus court costs. He is represented by Bart J. Galvin of Winters, Salzetta, O'Brien, and Richardson LLC in Chicago.
