Mother sues two businesses, alleging negligence in daughter’s injury

A Cook County woman is suing a day care facility and a second business on behalf of her minor daughter alleging negligence and premises liability when the child sustained a broken elbow in a day care outing.

Lashonta Charles filed a lawsuit, as next friend of Mariah Charles, Sept. 21 in Cook County Circuit Court against First Step Learning Daycare Inc. and K&S Entertainment, alleging both defendants were in breach of duty when the girl suffered injuries while unsupervised.

According to the complaint, on Aug. 15, 2014, the 5-year-old child was enrolled at the First Step Learning Daycare program, 6401 S. Ashland Ave., Chicago, and the day care class took a trip to K&S Entertainment’s “Monkey Island” recreation center on North 15th Avenue, Melrose Park.

The lawsuit states First Step knew or should have known that the child’s age, maturity and cognitive level indicated a high level of supervision was necessary on outings and that both defendants failed to supervise Mariah Charles, maintain discipline among the students, prevent other students from assaulting the girl and enforce safety measures.

The suit says the child experienced pain, suffering and emotional trauma, was hindered in her activities from the fracture and incurred medical expenses.

Lashonta Charles seeks more than $50,000, plus attorney fees and costs. She is represented by attorneys Bradley Skafish and Jeffrey Deutschman of Deutschman & Associates in Chicago.
