Janitorial business alleges factory committed breach of contract

A DuPage County company is suing a Chicago business, alleging breach of contract.

Total Facility Maintenance Inc. (TFM) of Wood Dale filed a lawsuit Oct. 2 in Cook County Circuit Court against Universal Holdings I doing business as Smith Brothers Company, whose principal place of business is in Chicago.

According to the complaint, TFM signed a three-year contract with Smith Brothers on April 24, 2014, to provide janitorial services to the Smith facility at 3501 W. 48th Place in Chicago for $19,828.83 per month. On Sept. 28, 2015, the suit says, the defendant told TFM employees the factory was being shut down.

The suit says a number of invoices, totaling $138,934.50 for May 1-Sept. 30, remain unpaid.

Total Facility Maintenance seeks damages of more than $50,000, including compensation for the unpaid invoices as well as for the remaining 19 months of the contract. It is represented by attorney Joseph Howard of The Law Offices of Joseph G. Howard in Chicago.
