Daughter sues hospital, physician alleging misdiagnosis in father's death

A Cook County woman is suing a doctor and a hospital, alleging malpractice and wrongful death involving her father.


A Cook County woman is suing a doctor and a hospital, alleging malpractice and wrongful death involving her father.

Luckeyia Polk-Murry, special administrator of the estate of Nelson Polk, filed a lawsuit Oct. 5 in Cook County Circuit Court against Advocate South Suburban Hospital in Hazel Crest, Midwest Anesthesiology and Dr. Ajit Kumar.

According to the complaint, on Oct. 7, 2013, Nelson Polk suffered injuries while under the defendants’ care for diagnostic tests when the defendants failed to correctly interpret test results and did not report the abnormal results. As a result, the suit says, Polk suffered painful injuries and disability requiring further medical treatment and expenses.

Ultimately, these injuries led to Polk’s death Oct. 9, 2013, according to the suit.

Polk-Murry seeks a jury trial and damages of more than $50,000, plus litigation costs. She is represented by attorney Robert A. Montgomery of Chicago.
