Shopper blames Food 4 Less for injuries from fall on ice

CHICAGO – A Cook County woman is suing Kroger’s Food 4 Less store and its landlord, alleging she suffered injuries from a fall on the store’s icy sidewalk.

Haydee Berlanga filed a lawsuit Jan. 4 in Cook County Circuit Court against Kroger Co., doing business as Food 4 Less, Cole MT Melrose Park  LLC and American Realty Capital Properties Inc., alleging liability for personal injury.

According to the complaint, on Jan. 5, 2014, Berlanga was entering the Melrose Park store from its parking lot when she slipped on an ice-covered walkway leading to the entrance. The suit says Food 4 Less neglected to inspect the common areas of its premises for safety, posted no warning signs and failed to maintain the walkway in a safe condition for customers. 

As a result, the suit states, the plaintiff suffered permanent injuries requiring future medical treatment.

Berlanga seeks damages of more than $50,000, plus litigation costs. She is represented by attorney Jonathan Schlack of the Law Offices of Jonathan Schlack PC in Chicago.
