CHICAGO — A couple's suit against a doctor, a hospital and a medical practice alleges that a pregnancy aborted on grounds that it was ectopic was found to be consistent with an intrauterine pregnancy.
Criselda Ortega and Mario Ortega are suing Blue Island Hospital Company LLC, MSMC Investors LLC and Community Health Systems Inc., all doing business as MetroSouth Medical Center; Pronger Smith Medical Care; and Dr. Shelly Agarwal, citing alleged negligence.
The couple filed a complaint on Feb. 22 in Cook County Circuit Court, holding the defendants responsible for allegedly misdiagnosing an intrauterine pregnancy as an ectopic pregnancy, only to find the alleged error in connection with an abortion.
The plaintiffs claim Agarwal diagnosed Criselda Ortega with an ectopic pregnancy on Feb. 20, 2014, and initiated an attempted chemical abortion the next day, followed by a second injection of a chemical abortion drug a week later. The plaintiffs allege that during a subsequent dilation and curettage on March 8, 2014, it was found that there was no evidence of an ectopic pregnancy. The plaintiffs further allege that a pathology report on March 11, 2014, found the specimens to be consistent with an intrauterine pregnancy.
The plaintiffs seek the following: compensation for such relief in favor of the the plaintiff as the court deems just and fair, in an amount in excess of $50,000. They are represented by James A. Karamanis of Barney & Karamanis, LLP in Chicago.
