CHICAGO — An attorney is suing a Westchester nursing care and rehabilitation facility, alleging negligence caused injuries to her client.
Barbara King, as power of attorney for the property of Margaretta Randolph, filed a lawsuit April 26 in Cook County Circuit Court against SSC Westchester Operating Company LLC and Westchester Health And Rehabilitation Center, alleging they knowingly violated the Illinois Nursing Home Care Act by failing to provide adequate assistance and supervision in giving care and treatment to Randolph.
According to the complaint, between March 20, 2014, and March 25, 2015, Margaretta Randolph suffered multiple injuries, including a contusion to her upper lip and nose, left hip swelling and bruising under her left eye that resulted from numerous falls. The suit says these falls led to suffering and permanent disability.
The plaintiff alleges the defendants failed to adequately assist and supervise Randolph in her daily activities inside the facility to prevent her from falling and sustaining injuries.
King seeks a trial by jury and more than $50,000 in damages. She is represented by attorneys Brian J. Holmes and Michael T. Mertz of Hurley McKenna & Mertz in Chicago.
