CHICAGO — The administrators of an estate are suing the owners and operator of a truck, alleging negligence caused a fatality.

Eugene Henley, Linda Henley and Alphonso Henley, as special administrators of the estate of Georgiana Henley, filed a lawsuit May 3 in Cook County Circuit Court against Power Play Distributors LLC, Home Run Inn Inc. and Carlos Sanchez, alleging breach of duty, negligence and wrongful death in the failure to exercise caution in operating a vehicle.

According to the complaint, on Jan.12, while Georgina Henley was crossing the intersection of La Salle and Division in Chicago she was without warning hit by an International straight truck driven by Sanchez, an employee of Home Run Inn and Power Play Distributors. The collision led to severe injuries for Henley who died later that day at Northwestern Memorial Hospital, the suit says.

The plaintiffs allege Sanchez failed to yield the right of way to pedestrian, failed to exercise care and in driving the vehicle, failed to maintain proper lookout and failed to take evasive action to avoid Georgina Henley.

The Henleys seek a trial by jury, compensation for wrongful death and survival damages, funeral expenses, legal costs and such other relief as the court deems equitable. They are represented by attorney Nuru Witherspoon of The Witherspoon Law Group in Chicago.
