Couple blames Morton Grove tavern for assault on husband

CHICAGO — A couple is suing a Morton Grove tavern, alleging negligence in failure to prevent another patron from attacking the husband.

Robert Hancock and Penny Hancock filed a lawsuit May 25 in Cook County Circuit Court against Cal-Oak, Inc., doing business as Bringer Inn, North & South Side Inc., Tom English, Mike Cummings and James Fergus, alleging violation of the Dram Shop Act in serving alcoholic beverages to Fergus, causing him to be intoxicated.

According to the complaint, on June 12, 2015, Robert Hancock sustained injuries as a result of being battered by Fergus at Bringer Inn in Morton Grove. The plaintiffs allege the defendants are responsible because Fergus had been intoxicated with alcohol and they failed to provide adequate security for other patrons.

The suit says Hancock sustained pain and suffering, disfigurement, disability, loss of normal life and medical costs. 

The Hancocks seek more than $50,000 from each defendant, plus court costs. They are represented by Trapp & Geller of Trapp & Geller in Chicago.
