Nursing home blamed for pressure sores in wrongful death suit

CHICAGO — An administrator of a deceased man's estate is suing Aria Post Acute Care, LLC, d/b/a Aria Post Acute Care; Nucare Services Corp., LLC; Janmela Newman, LPN; and Ma Scylla C. Wilkins, RN, in a wrongful death suit alleging failure to provide proper care in a nursing home.

Michael D. Frustini, as independent administrator of the estate of Louis Frustini, filed a complaint on June 26 in Cook County Circuit Court against the defendants, alleging that they failed to provide proper care to Louis Frustini.

According to the complaint, the plaintiff alleges that, Louis Frustini, a resident of Aria from June 28 to Aug. 10, 2014, developed pressure sores which deteriorated his overall health and in turn contributed to and/or caused his death on Nov. 6, 2014. The plaintiff holds the defendants responsible because they allegedly failed to provide adequate supervision to Louis Frustini in order to avoid the development of pressure sores.

The plaintiff seeks judgment against the defendants in an amount in excess of $50,000. He is represented by Susan L. Novosad and Daniel A. Goldfaden of Levin & Perconti in Chicago.
