Communications company claims damages by excavator

CHICAGO — A communications company is suing Mario Conte Excavating Inc., citing alleged negligence.

Vinakom Communications Inc. filed a complaint on Aug. 4 in Cook County Circuit Court against Mario Conte Excavating Inc., alleging that the defendant started digging without ensuring that the plaintiff had placed flags at the location.

According to the complaint, the plaintiff alleges that in August 2015, Vinakom Communications Inc. suffered damages as the result of its fiber wires being damaged due to digging. The plaintiff holds Mario Conte Excavating Inc. responsible because the defendant allegedly failed to verify that all the individuals listed on its "locate" request had placed their flags in the area and/or wait for 48 hours for individuals to properly mark the area.

The plaintiff seeks judgment against the defendant in an amount in excess of $50,000 plus court costs, interest, and any further relief the court grants. It is represented by Anish Parikh of Parikh Law Group, LLC in Chicago.
