Merendero San Marcos Bar & Grill accused of not protecting man from assault by other patrons

CHICAGO — A man is suing Dona Cuca Inc., which does business as Merendero San Marcos Bar & Grill, alleging negligence and liability, after owners and staff at the establishment didn't protect him from being assaulted by other patrons.

Ivan Carrillo filed a complaint on Oct. 7 in Cook County Circuit Court against the defendant, alleging that the establishment failed to provide adequate security personnel.

According to the complaint, the plaintiff alleges that in October 2014, he sustained physical injuries after being physically assaulted by other patrons inside the bar. The plaintiff holds the defendant responsible for allegedly failing to take appropriate steps to protect the plaintiff from being assaulted.

The plaintiff seeks judgment against the defendant in an amount that exceeds the jurisdictional limits of the court plus court costs. He is represented by Kevin J. McNamara of Kevin J. McNamara Law Offices, P.C. in Chicago.
