Doctor, Good Samaritan Hospital sued by woman alleging procedure perforated her esophagus

CHICAGO A patient claims her esophagus was injured because of an improperly performed medical procedure.

Nicole Ackerman filed a complaint on Nov. 18 in Cook County Circuit Court against Rockford G. Yapp, M.D.; Digestive Health Services, S.C.; and Advocate Good Samaritan Hospital, alleging medical malpractice.

According to the complaint, the plaintiff alleges she swallowed a dental appliance and went to the Good Samaritan Hospital emergency room on April 20, 2011. She alleges that an endoscopic procedure was performed and that the procedure perforated her esophagus, after the defendants allegedly failed to use a device that was capable of securing the dental appliance during the surgery, and failed to advise the plaintiff of the surgery's risks.

The plaintiff seeks judgment against the defendants in an amount that exceeds the jurisdictional limits of this court. She is represented by Glen J. Dunn Jr. of Glenn J. Dunn & Associates LTD in Chicago and James D. Montgomery Jr. of Montgomery Law Firm LLC in Chicago.
