CHICAGO — A deceased man's family has filed a wrongful death claim against Highland Park CVS LLC, alleging a prescription for epilepsy medication was filled incorrectly, leading to the man's death.
Donna Harper, independent administrator of the estate of Patrick B. Harper, filed a complaint on Jan. 24 in Cook County Circuit Court against the defendants, alleging they failed to provide the proper prescription medication to Patrick B. Harper.
According to the complaint, the plaintiff alleges Harper suffered from epilepsy and died following a series of seizures after his Depakote dosage fell below therapeutic levels. The plaintiff holds the defendants responsible for allegedly filling a prescription for Depakote DR (delayed release) with the incorrect medication Depakoe ER (extended release), and for not correcting the mistake when asked why the tablets had a different appearance.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount greater than $50,000. She is represented by Mark E. McNabola and Ruth M. Degnan of McNabola Law Group, P.C. in Chicago.
