Depuy Orthopaedics, Premier Orthopaedic Sales allegedly failed to prevent use of defective device

CHICAGO — A patient is suing Depuy Orthopaedics Inc. and Premier Orthopaedic Sales Inc., an Indiana corporation, for allegedly taking insufficient measures to prevent the manufacture, sale and use of a defective artificial hip implant.

Joseph Spivak filed a complaint on March 8 in Cook County Circuit Court alleging the defendants manufactured a defective hip implant.

According to the complaint, the plaintiff alleges he sustained physical injuries from having high concentrations of various metallic elements in his blood as the result of the failed medical device. The plaintiff holds the defendants responsible for allegedly failing to warn the plaintiff and his physicians of the possible defects of the device.

The plaintiff seeks judgment against the defendants in an amount that exceeds the jurisdictional limits of this court plus interest and court costs. He is represented by Richard J. Grossman of Steinberg Burtker & Grossman Ltd. in Chicago.
