Widow says Metra, Village of Elmwood Park responsible for husband's death

CHICAGO — A widow is suing Metra, a train engineer and another unknown train operator, and the Village of Elmwood Park, claiming her 82-year-old husband was struck and killed by a train due to negligence.

Fatima Yonan, individually and as special administrator of the estate of Jack Yonan, filed a complaint on April 13 in Cook County Circuit Court alleging the defendants failed to make sure the Metra train that killed her husband was being operated with caution.

According to the complaint, the plaintiff alleges that, on April 15, 2016, Jack Yonan was struck by a train while walking across the tracks in Elmwood Park. The plaintiff holds the defendants responsible because the engineer allegedly failed to keep a proper lookout while operating the train, among other transgressions of the transit agency and village.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount greater than $50,000 and any further relief this court grants. She is represented by Bradley E. Prendergast of Chicago.
