Multimedia Sales & Marketing Inc. allegedly collected employees' fingerprint scans without consent

CHICAGO — A man has filed a class action lawsuit against Multimedia Sales & Marketing Inc., alleging the employer improperly collected scans of his fingerprints, as well as those of other workers, in violation of an Illinois law.

Francisco Lopez filed a complaint on Nov. 29 in Cook County Circuit Court, alleging the company failed to inform workers why their biometric information was being collected and the purpose for which the company needed to collect such information. The workers would use the fingerprint scans to operate an employee punch clock, to punch in and out of work shifts and log their hours worked.

The plaintiff requests a trial by jury and seeks statutory damages of $5,000, order the defendant to permanently destroy all of his biometric information, statutory damages of $1,000, court costs, interest and any further relief this court grants. He is represented by Myles McGuire and William P. Kingston of McGuire Law P.C. in Chicago.
