Fiesta Americana, of Stone Park, sued for allowing man to drive off while intoxicated, allegedly cause fatal crash

CHICAGO — A woman is suing Toju Bay Inc., Fiesta Americana Restaurant & Club and a man, identified as Sergio Rios, for wrongful death and allegedly taking insufficient measures to prevent injuries.

Gonzala Gutierrez Rosas, independent administrator of the estate of Cindy Baez Gutierrez, filed a complaint on Feb. 14 in Cook County Circuit Court, alleging the defendants allowed Rios to consume a high volume of alcoholic beverages. Rios later was driving, and the car he was driving collided with one driven by Baez Gutierrez in the early morning hours of February 22, 2017, near the intersection of Mannheim Road and Lake Street in Stone Park. Baez Gutierrez died following the crash. The plaintiff holds the defendants responsible for allegedly allowing the man to drive his vehicle despite allegedly showing signs of intoxication.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds the jurisdictional limits of this court. She is represented by Robert J. Bingle of Corboy & Demetrio P.C. in Chicago.
