Estate administrator sues men who allegedly attacked another, who died two days later

CHICAGO — An estate administrator is suing a man who allegedly assaulted a pedestrian, who later died.

James Lowry, as administrator of the estate of the late Kristopher Weiss, filed a complaint July 19 in Cook County Circuit Court against Phillip Levato, alleging, while Weiss was walking on July 22, 2016, Levato and a passenger in his vehicle allegedly got out of the vehicle and allegedly assaulted him. Levato allegedly punched Weiss on the side of the head causing him to fall straight back, hit his head on the cement and lose consciousness. Weiss died on July 24, 2016.

The plaintiff requests a trial by jury and seeks a judgment greater than $50,000, plus interest and costs. He is represented by Brian McGinnis of John M. Molloy & Associates in Chicago.
