Widow alleges husband died after falls while at Presence St. Mary's Hospital

CHICAGO – A widow alleges the nursing and technical staff at a hospital failed to prevent her husband from falling while in their care.

Margarita Rivera, as special administrator of the estate of Antonio Rivera, filed a complaint on Nov. 1 in Cook County Circuit Court against Presence Health and others, citing the Wrongful Death Act.

According to the complaint, the plaintiff alleges on Nov. 1, 2016, Antonio Rivera went to Presence St. Mary's Hospital for complaints of various ailments requiring medical or surgical treatment. The suit states Antonio Rivera died on Nov. 7, 2016, from injuries he sustained from falling twice while under the care of the defendants.

The plaintiff alleges the defendant failed to initiate appropriate fall protections and failed to prevent Rivera from falling during therapy.

The plaintiff seeks judgment against defendants for damages of more than $50,000 and other relief. She is represented by Ian R. Alexander of Goldberg & Goldberg in Chicago.
