CHICAGO – A resident of a Chicago long-term nursing care facility alleges the facility failed to protect him from a fall that caused multiple fractures.
Bobbie Talley Jr. filed a complaint on Nov. 14 in Cook County Circuit Court against Symphony at Midway, citing the Nursing Home Care Act.
According to the complaint, on Sept. 16, 2016, the plaintiff was admitted at defendant's nursing home for rehabilitative services and was a high risk for falls. The suit states on Nov. 25, 2016, he fell while in the defendant's care and sustained multiple fractures in his left leg.
The plaintiff alleges the defendant failed to protect plaintiff from abuse and neglect and failed to provide properly supervised nursing and personal care to meet his total nursing and personal care needs.
The plaintiff requests a trial by jury and seeks judgment of more than $50,000, plus attorney fees and costs as provided by statute. He is represented by Matthew K. Henry of the Law Offices of Steven J. Malman & Associates PC in Chicago.
