CHICAGO – An estate administrator is seeking damages from a Des Plaines nursing home over a former resident's fall.

Joseph Furst, as independent administrator of the estate of Lydia Cangiano, filed a complaint on Dec. 27 in Cook County Circuit Court against Lee Manor Nursing Residence, alleging negligence and wrongful death.

According to the complaint, the plaintiff alleges in January 2017, while a resident of the defendants' facility, Cangiano sustained an unwitnessed fall and was subsequently found lying on the floor next to her bed. The suit states she was admitted to Advocate Lutheran General Hospital and diagnosed with a subcapital hip fracture. The suit states she died five days later.

The plaintiff alleges the defendants failed to protect the patient from neglect and failed to provide her with the care and supervision needed to prevent her from falling.

The plaintiff seeks more than $50,000, plus attorney fees and costs. He is represented by Michael F. Bonamarte and Bryan A. Ruggiero of Levin & Perconti in Chicago.
