Bicyclist sues over injuries in crash

A bicyclist is suing the driver he claims injured him while driving in Evanston.

Christopher Zigmont filed a complaint May 29 in Cook County Circuit Court against Cindel Paswater.

According to the lawsuit, on Sept. 24, 2013, Paswater was driving a 2000 Lexus RX300 sport utility vehicle south on Clybourn Avenue near the Market Square Treasure Island driveway when she struck Zigmont on his bicycle.

Paswater is cited with carelessness and negligence for failing to yield the right of way; moving from a lane of traffic without ascertaining the safety of doing so; exercise due care to avoid colliding with Zigmont; steer clear of a bicyclist; drive at a safe speed; apply her brakes; and keep her vehicle under proper control.

As a result, Zigmont suffered injuries, pain and suffering, medical expenses and loss of earning capacity and normal life.

The plaintiff seeks damages in excess of $50,000, plus costs. The plaintiff is represented by Michael S. Keating and James P. Lynch of the Keating Law Offices in Chicago.
