Woman sues over son's bike accident

A woman is suing on behalf of her son, who allegedly was injured by a motorist when he was riding his bike in 2014.

Maria Perez, as mother of the minor Jacob Cuautle, filed a complaint on May 29 in Cook County Circuit Court against Gladys Hernandez.

On Sept. 23, 2014, Jacob Cuautle was riding his bike west at 4400 W. Drummond Place, near Kostner Avenue, Chicago. At the same time, according to the lawsuit, Hernandez was driving her vehicle north on Kostner Avenue, near the same intersection, resulting in a collision.

The defendant is cited with negligence for failing to drive at a safe speed, yield to a bicyclist, stop or slow when danger was imminent, sound her horn, keep a proper lookout, and keep control of her vehicle.

As a result, the lawsuit states, the boy suffered injuries, pain and suffering, and accrued medical expenses. The plaintiff seeks damages in excess of $100,000, plus costs.
