Man's fall that lead to death results in lawsuit

The estate of a man who fell in a nursing home and later died has sued the parties involved.

Eva Penaloza, as administrator of the estate of Adelfo Penaloza, filed a lawsuit May 27 in Cook County Circuit Court against: THC-North Shore Inc., doing business as Kindred Chicago Lakeshore; Dr. Shakib Sakla, Dr. Samina Khan and Dr. Vivek Gupta; and nurses M. Sebastian, I. Iyare and E.S. Thomas.

According to the complaint, the deceased was a resident of Kindred from July 2-July 3, 3013, then died the next day. The lawsuit states. on July 3, the defendants were guilty of the Nursing Home Act in failing to: properly supervise, care for and prevent injuries to Adelfo Penaloza; keep him from falling; protect him from harm, provide fall protection and a bed alarm; activate side rails and warnings; prevent neglect to Penaloza. 

As a result, the lawsuit states, Penaloza suffered injuries that led to his death.

Eva Penaloza seeks damage in excess of $350,000, plus costs. She is represented by Trapp and Geller in Chicago.
