Parking lot pedestrian struck by truck sues operator, owner

A Cook County resident filed suit against an Illinois business and its employee for alleged motor vehicle negligence in 2014.

William C. Mayfield filed a lawsuit June 2 in Cook County Circuit Court against Luis Rios Aguilera, also known as Luis Aguilera Rios, and Mr. Bult’s Inc. on a complaint of vehicular negligence in an October 2013 accident that left him with injuries.

The suit states that Mayfield was legally walking in the parking lot of the defendant’s premises at 1700 Church St. in Evanston on or about Oct. 29, 2013, when he was struck by a Kenworth Truck used by the business and driven by Aguilera/Rios.

According to the filing, the driver proceeded to back up in a northerly direction and collided with Mayfield, knocking him to the pavement.

The defendants are faulted for carelessly and negligently operating the vehicle without keeping a sufficient lookout for pedestrians; failing to decrease the truck’s speed; reversing the vehicle suddenly; and failing to yield the right of way to the plaintiff, who was directly in the truck’s path.

The complaint also blames the driver for neglecting to give audible warning and/or alter his direction to avoid the accident.

The plaintiff seeks damages in excess of $50,000 and attorneys’ fees and costs. He is represented in the case by Sheldon I. Minkow & Associates in Chicago.
