Public transit passenger alleges vehicular negligence

A Cook County man is suing the Chicago Transit Authority and three individuals in an accident that allegedly caused him injuries.

Philip Filipski filed a lawsuit June 10 in Cook County Circuit Court against the Chicago Transit Authority, Jae Won Kim, Moung S. Kim and Sherrie J. Lemons, alleging vehicular negligence.

According to the filing, on Feb. 28, Jae Won Kim was operating a motor vehicle owned by Moung S. Kim exiting the Kennedy Expressway at Lawrence Avenue at about 7:50 a.m. in order to make a right-hand turn onto westbound Lawrence. Sherrie Lemons was driving a vehicle owned by Chicago Transit Authority in which Filipski was a passenger, the suit says.

The suit states Lemons was traveling westbound on Lawrence when Kim’s vehicle came into contact with the CTA vehicle, allegedly injuring the plaintiff. The complaint states the defendants: negligently and carelessly failed to control their vehicles; keep a proper lookout; maintain a proper speed and distance from other vehicles; warn of a collision; brake properly; and yield the right of way.

The plaintiff alleges personal and pecuniary injuries.

Filipski seeks damages in excess of $50,000, plus attorney fees and costs. He is represented by attorney Daniel Scott of Chepov & Scott in Chicago.
