Drugstore shopper alleges falling crate injured her

A Cook County woman is suing CVS, alleging she was injured by a falling soda bottle crate at the chain's store at Clark and Division on Chicago's Near North Side.

Marcia Maras filed a lawsuit June 15 in Cook County Circuit Court against Highland Park CVS, doing business as CVS/Pharmacy No. 8698, alleging negligence when she was injured by a falling crate containing 2-liter soda bottles.

According to the complaint, on May 22, Maras was shopping at the CVS store at 1165 N. Clark St., Chicago, and when she removed a 2-liter soda bottle stacked at the top of a tower of crates inside the store, the topmost crate fell and struck her, causing severe injury. The suit states CVS negligently stacked the crates too high, should have known the stack was unstable, and should have inspected and monitored the pile to ensure that it was in a stable condition. Maras also faults store management for failing to warn customers of the potential hazard.

The plaintiff maintains, as a result of the defendant’s negligent acts or omissions, she has incurred and expects to continue to incur financial loss, including medical costs and loss of income.

Maras seeks damages of more than $50,000, plus attorney fees and costs.
