A Northbrook man is suing on behalf of his disabled mother and as executor of his deceased father’s estate against a grocery business, alleging breach of contract.

Irwin Friedman of Northbrook filed a lawsuit as guardian of Rosalyn E. Friedman and trustee of the Albert S. Friedman Revocable Trust U/A/D 3/18/1982 June 18 in Cook County Circuit Court against Banner Wholesale Grocers of Chicago, seeking resolution of a monetary dispute.

According to the filing, on Dec. 31, 2011, Banner secured three loans from Albert and Rosalyn Friedman with principal balances of $412,083.82, $219,880.48 and $287,294.44. The suit states the defendant has made no payments since the date of the purchase agreement.

The suit alleges Albert and Rosalyn advanced the principal amount of each of the three loans as stated in the original purchase agreement, and that the contract states that each loan bears interest at the applicable federal rate.

Friedman seeks judgment against Banner Wholesale Grocers for all principal amounts plus accrued interest as of Dec. 31, 2014, for a total of $1,007,224.10, plus attorney fees and costs. He is represented by attorney Robert Markoff, R. Timothy Novel, and Chirag Patel of Markoff Law in Chicago.
