The estate of a boy killed in a pedestrian accident is suing the driver who allegedly caused his death.
Maria Lomas, as administrator of the estate of Jimmy Lomas, filed a complaint June 16 in Cook County Circuit Court against Erick A. Ochoa, citing wrongful death and provisions under the Family Expense Act.
According to the complaint, on July 20, 2013, Ochoa was driving east on 47th Street, approaching Harding Avenue in Chicago, when he struck Jimmy Lomas, a minor, and caused fatal injuries.
Ochoa is cited with negligence and carelessness in driving at an unsafe speed, driving under the influence of intoxicants, driving without adequate brakes, driving while talking or texting on his cellphone, and for failing to keep a proper lookout, keep his vehicle under control, decrease speed, stop in time to avoid a collision, and sound his horn to warn Jimmy Lomas.
Maria Lomas seeks damages in excess of $100,000, plus costs. She is represented by attorney Lisa K. Lange of the Law Office of Lisa K. Lange in Chicago.
