Woman sues over trip-and-fall accident

A woman is suing a local retailer after tripping and falling at the store.

Christina Garcia filed a complaint on June 26 in Cook County Circuit Court against Kmart Corp. and Sears Brands LLC.

On July 5, 2013, Garcia was at the Kmart store at 17355 S. Torrence Ave., Lansing Village. A soapy substance on the floor, the lawsuit states, caused Garcia to trip and fall, causing her injury, pain and suffering, and medical expenses.

The defendants are cited with allowing a dangerous condition to exist, maintaining the premises in a defective condition, allowing a dangerous condition to persist and failing to remedy the condition, maintain the premises and warn the plaintiff about a hazardous condition.

The plaintiff seeks damages in excess of $100,000, plus costs. The plaintiff is represented by David J. Gallagher of the Vrdolyak Law Group LLC in Chicago.
