A man's legal representative sued a nursing care center for allegedly neglectful care.
Anna Marie Throckmorton, as attorney-in-fact for Peter Throckmorton, filed a complaint June 24 in Cook County Circuit Court against Asta Care Center of Bloomington LLC, Asta Health Care Co. Inc., Seth Gillman and Michael Gillman.
On Feb. 14, 2013, Peter Throckmorton was admitted to Asta and during the course of his stay, despite assessments that showed him to be at risk for falls, skin breakdown and edema, developed drainage in his right lower extremity and various pressure ulcers to his right thigh and right foot. Ultimately, the lawsuit states, he developed severely infected wounds, pneumonia, skin tears to his right arm and hematoma on the side of his forehead.
As a result of these injuries, the lawsuit states, Throckmorton experienced painful wounds requiring the removal of his right leg above the knee, skin tears and hematoma from a fall when left unsupervised. He also experienced respiratory distress and pneumonia which made him allegedly suffer a diminishing of his physical and mental status, pain and suffering, and medical expenses.
The plaintiff, citing violations of the state Nursing Home Care Act, seeks damages in excess of the court's jurisdictional limits, plus costs.
