Estate alleges driver in fatal accident was drunk

The estate of a deceased man is suing a driver whose alleged intoxication caused the accident that killed the man.

Joel Ibarra Sr., as administrator of the estate of Joel Ibarra Jr., filed a lawsuit June 23 in Cook County Circuit Court against Hector Diaz and Edgar Rodriguez, alleging negligence, willful and wanton behavior.

According to the complaint, on June 24, 2013, Diaz was driving a vehicle owned by Rodriguez, west down Archer Avenue near Hamilton Avenue in Chicago, when Ibarra Jr. was driving east on Archer Avenue. The suit says Diaz slammed his vehicle into Ibarra Jr.'s vehicle, causing injuries that led to his death.

The suit states the defendants (the driver and owner of the vehicle) were driving dangerously, collided with Ibarra, failed to keep the vehicle under control, driving while intoxicated, crossing the center line, and not maintaining the vehicle in a safe manner.

The plaintiff alleges expenses for funeral costs.

Joel Ibarra Sr. seeks damages in excess of $330,000, plus costs. He is represented by attorney Paul G. O'Toole of Salvato & O'Toole in Chicago.
