Woman sues over car wash injuries

A local car wash is being sued by a customer who was injured after allegedly slipping on ice in car wash bay.

Barbara Arbuthnot filed a complaint June 12 in Cook County Circuit Court against Chicagoland Car Wash Inc.

On Feb. 23, 2015, Arbuthnot was cleaning her vehicle at the defendants facility, at 7303 W. Dempster St. in Niles. According to the lawsuit, Arbuthnot then slipped and fell on an "unnatural accumulation of ice inside of a car wash bay," which occurred due to a leak in the "soapy pressure cleaner and extended several feet toward the center of the declined surface."

The defendant is cited with negligently and carelessly failing to provide a safe bay area; maintain the bay area; create a hazard-free area; warn the plaintiff of a dangerous condition; maintain the grounds and remove the snow and ice; and inspect the bar area.

As a result, Arbuthnot suffered injuries, pain and suffering, loss of wages and medical expenses.

The plaintiff seeks damages in excess of the court's jurisdictional limits, plus costs.

The plaintiff is represented by David A. Baez of Willens Law Offices PC in Chicago.

Cook County Circuit Court case number 2015L005995.
