Carpenter alleges negligence in workplace injuries

A carpenter is suing the owner of a Wheaton property, alleging injuries in a workplace fall.

Darren Kasparian filed a lawsuit June 12 in Cook County Circuit Court against Draper and Kramer Inc. of Chicago and Thyssenkrupp Safeway Inc., alleging negligence.

According to the complaint, on May 19, 2009, Kasparian was working as a carpenter for Berglund Construction Co. at a D and K-owned property called Wheaton Center, at 2 Wheaton Center, Wheaton. Due to negligent and careless acts or omissions of the building's owners, the suit says, Kasparian fell and suffered "severe and permanent injuries" as well as pain and suffering, and medical expenses.

The suit alleges the defendant failed to control its premises, exercise due care, allowed a dangerous condition to persist, failed to warn the plaintiff of a hazardous condition, did not assess and maintain the balcony area, building units and work areas to ensure a safe environment, failed to provide competent supervision and safe work rules, allowed an unsafe condition to persist, ignored workers' requests and complaints about an unsafe condition, ignored OSHA standards, negligently trained staff, hired non-union workers, failed to remove restrictions relating to access to the 18th to 20th floors of the building, and did not use care in supervising employees.

Kasparian seeks damages in excess of the court's jurisdictional limits, plus costs. He is represented by attorneys Kenneth J. Allen and Otto J. Shragal of the Kenneth J. Allen Law Group in Valparaiso, Ind.
