A patient is suing a doctor and her supervising institutions for allegedly leaving an instrument inside her body during surgery.

Stacey Magana filed a lawsuit June 10 in Cook County Circuit Court against Dr. Jackie Jeruss, Northwestern Memorial Hospital, Northwestern Medical Faculty Foundation and Northwestern Medical Group, alleging medical negligence.

According to the lawsuit, on June 19, 2013, Magana had surgery to excise a cyst in her left breast, as well as a biopsy. The suit says during the procedure a metal ribbon clip was left in her breast, causing her to suffer severe disfigurement and infection.

The lawsuit alleges the defendants, as practitioner and supervising institutions, are guilty of carelessness and negligence in failing to remove the clip, make sure the surgical site was safe, and promptly advise Magana the clip was still inside her.

As a result, the lawsuit states, the plaintiff suffered pecuniary and personal injury.

Magana seeks damages in excess of $200,000 ($50,000 from each defendant), plus costs. She is represented by attorney Scott B. Wolfman of the Law Offices of Scott B. Wolfman and Associates in Chicago.
