Real estate developer, companies hit with personal injury suit

A man has sued the owner of a Chicago commercial building who he claims shoved him.

Frank Platchek filed a two-count personal injury complaint earlier this month in Cook County Circuit Court against Tem Horwitz, as well as Horwitz & Co., Horwitz & Co. Management Inc., Horwitz Investments LLC and Washington Des Plaines LLC.

Platchek asserts that he was at Teena Mia restaurant in a commercial building at 651 W. Washington Blvd. on Jan. 18, when Horwitz “without provocation, just cause, or legal defense, physically shoved” him.

His suit accuses Horwitz, as well as the defendant companies that own, lease, control and manage the building, of failing to exercise due care for his safety, negligence that Platchek contends made him suffer “injuries of a personal and pecuniary nature.”

Platchek also asserts that the defendants “failed to control, manage or otherwise intervene in the anger management issues of ... Tem Horwitz.”

The suit includes counts for negligence and willful and wanton conduct, each of which seeks a judgment against the defendants for a sum in excess of the Law Division’s jurisdictional limits.

According to yelp.com, Teena Mia apparently closed earlier this year. Numbers listed for restaurant have been disconnected and its website appears to be defunct.

A company profile for the restaurant on manta.com lists Platchek as one of the owners. His lawsuit makes no mention of him being an owner, only noting that he was lawfully upon the premises when the alleged incident occurred.

Daniel S. Kirschner, a partner at Corboy & Demetrio P.C. in Chicago, submitted the suit on Platchek’s behalf.
