Estate executors claim Geneva facility violated the Nursing Home Care Act

Geneva Nursing and Rehabilitation Center is facing a lawsuit over claims they violated the Nursing Home Care Act.

Jane Warren and Sharon Stratton, as co-executors of the Estate of Joan Thomas, deceased, filed a lawsuit Oct. 17 in Cook County Circuit Court against Geneva Nursing and Rehabilitation Center LLC, citing violations of the Nursing Home Care Act and wrongful death.

The plaintiffs state that from July 2, 2011 to Aug. 19, 2012, Thomas was a resident of Geneva Nursing and Rehabilitation Center, located at 1101 E. State St. in Geneva.

On Aug. 1, 2012, Thomas sustained a a right distal femoral shaft fracture after the defendant transferred or repositioned her, according to the complaint. The plaintiffs state Thomas died from the injuries on Aug. 19, 2012.

The defendant abused or neglected Thomas, resulting in a violation of the Nursing Home Care Act, according to the complaint.

The plaintiffs are seeking more than $50,000 in damages. They are being represented in the case by the Law Offices of Steven J. Seidman in Chicago.
