A delivery man is suing a company after he fell and was injured while delivering concrete to the company's property.
James Hamilton filed a lawsuit Oct. 11 in Cook County Circuit Court against American Tower LLC and/or American Tower Holding Sub LLC and/or American Tower Asset Sub II LLC, citing negligence.
According to the complaint, on Oct. 14, 2011, Hamilton was at a communications site owned by the defendants in Odell, and in the process of delivering and pouring concrete for site maintenance.
Hamilton says the delivery area had been excavated, causing the ground to be uneven with numerous dirt mounds, pot holes and tree roots and that while delivering the concrete his foot was caught on a tree root that was covered by the excavated dirt mound, causing him to fall and injure himself.
Hamilton is seeking damages in excess of the jurisdictional limit. He is being represented in the case by attorney Matthew J. Coleman of Ridge & Downes.
