Mallard Cove Condominium Association, woman named in intentional battery lawsuit

Two men are suing a woman and condominium association after they were allegedly hit while helping move a man out of a residence.

Ariel Cudia and Michael Joseph Manning filed a lawsuit Oct. 18 in Cook County Circuit Court against Deanna L. Martucci and Mallard Cove Condominium Association, citing intentional battery and negligent battery.

The plaintiffs say that on Jan. 28, 2012, they were at Martucci's property, 1206 S. New Wilke Road in Arlington Heights, helping Martucci's father move out of the residence.

The complaint alleges that while they were at the home, Martucci verbally and physically assaulted, attacked and battered them including striking Cudia in the head multiple times with jumper cables.

The plaintiffs are seeking damages in excess of $50,000. They are being represented in the case by attorney Jason H. Sherwood of Sherwood Law Group LLC.
