Cook County couple sued for breach of contract

A Cook County man is suing a couple for breach of contract after building code violations were found after closing a real estate deal.

Aeron Maxwell filed a lawsuit Oct. 29 in Cook County Circuit Court against Eugenio and Maria Rodriguez, citing breach of contract, fraud and unjust enrichment.

According to the complaint, during 2012, the defendants owned a property that was listed for sale at 4815-17 W. Montana St. in Chicago.

Maxwell asserts in his suit that he and the defendants entered into a real estate contract on Aug. 19, 2012, for the sale of the property and the closing of the sale took place on Oct. 29, 2012.

He claims that following the closing, he received notification from the City of Chicago of 21 significant and substantial building code violations of the property. Maxwell contends he was unable to afford to make the repairs and sold the property for a loss of $76,161.96.

Maxwell is seeking a judgement for damages in that amount, plus treble damages in an amount equal to three times the amount of damages or $228,485.88, plus attorneys fees and costs.

He is represented in the case by attorneys from Joel C. Zimmerman & Associates Ltd.
