McDonald's customers sue over alleged attack

Two McDonald's customers are suing over claims they were attacked by employees.

Gustavo Pineda and Terry A. Forsia filed a lawsuit Nov. 5 in the Circuit Court of Cook County against McDonald's Corp., Wright Management Inc. and Armando Mejide Mir, Raul Flores, and Francisco Ortiz, the last three of whom were sued individually and as an  employee of Wright Management Inc. and/or McDonald's Corp.

The suit includes counts for negligence, battery, malicious prosecution, intentional infliction of emotional distress and false imprisonment.

The plaintiffs allege that they sustained serious injuries on Nov. 4, 2012, when they were attacked at the McDonald's at 6400 W. Montrose Ave. in Harwood Heights. They claim Mir, Flores and Ortiz struck and pushed them.

Following the incident, the suit states that Mir directed Harwood Heights Police to arrest the plaintiffs for battery. Mir failed to appear during the plaintiffs' court appearances and the charges against the plaintiffs were ultimately dismissed, the suit states.

The plaintiffs are seeking damages in excess of jurisdictional minimum. They are being represented by James L. Allegretti of Allegretti & Associates.
