Couple sues after home sellers allegedly conceal problems

Sussman

A couple is suing the sellers of home who they allege concealed water leakage in basement.

Meredith Paige Kroot and Jason M. Kroot filed a lawsuit Nov. 5 in Cook County Circuit Court against Shu B. Chan and Yvonne Lau.

According to the complaint, on April 12, the defendants owned a property at 3833 N. Claremont Ave. in Chicago.

The Kroots claim the defendants signed a residential real property disclosure report denying knowledge of flooding or recurrent leakage problems in the crawl space or basement, as well as material defects in the basement, foundation, walls or floors.

They assert, however, that from April 12 through the closing of the residential property, the defendants knew of material defects in the basement, including flooding and recurring water leakage, material defects in the basement or foundation that allowed water infiltration.

The Kroots are seeking damages in excess of $50,000 and all other relief available under state law. They are represented by attorney Jeffrey B. Sussman of Sussman, Selig & Ross.
