Woman struck by children's train inside mall sues for negligence

Marylin Carnahan filed suit Nov. 6 in the Cook County Circuit Court against Jolly Express of Chicago Inc. over allegations she sustained injuries at a shopping mall.

Carnahan alleges she was struck by the defendant's train, which runs indoors and carries children, in November 2012, when she was walking inside the Spring Hill Mall at 1072 Spring Hill Mall in West Dundee.

She claims she was struck by a Jolly Express train that was running throughout the mall and as a result, suffered injuries, incurred medical expenses and lost the enjoyment of a normal life.

Carnahan is suing Jolly Express for negligence and seeks to hold them liable for her injuries. She is seeking more than $50,000 in damages and is being represented by Chicago attorney Octavio Duran.
