Sacred Heart Hospital and local doctor face negligence and conspiracy lawsuit

A local hospital and doctor are facing suit over claims they provided negligent medical care and committed conspiracy.

Thomas V. Martin filed a lawsuit Nov. 21 in the Cook County Circuit Court against West Side Community Hospital Inc., doing business as Sacred Heart Hospital, and Dr. Subir Maitra, citing negligence and conspiracy.

The complaint states Martin was provided medical care by the defendants on Nov. 23 and Nov. 25 in 2011. He claims Sacred Heart Hospital failed to properly monitor surgical procedures to ensure services were actually provided and that the bills tendered were fair.

Martin contends Maitra negligently failed to screen and diagnose him, failed to perform operative procedure listed as performed and billed and was negligent in treatment. He also alleges that the defendants conspired to perform unneeded surgical procedures, including giving kick backs to Maitra and failing to perform peer review.

The plaintiff is seeking more than $50,000 in damages. He is being represented in the case by Karl A. Szymanski of Karl's Litigation Group.
